PowderWatts 10 Year Limited Warranty Certificate

This Limited Warranty Certificate confirms that the original purchaser of a PowderWatts System is entitled to the warranty coverage described below, subject to all terms, conditions, exclusions, and limitations contained herein and in the PowderWatts Terms of Service.

POWDERWATTS, INC.

1. PowderWatts Limited Warranty Coverage

PowderWatts warrants that PowderWatts-branded products purchased directly from PowderWatts or an authorized reseller (“Covered Products”) will be free from defects in materials and workmanship under normal residential or commercial use and service, subject to the terms of this Limited Warranty.

2. Parts Coverage

PowderWatts will provide replacement parts or a credit toward replacement parts for defective Covered Products based on the following prorated schedule:

Any prorated credit will be applied against the then-current retail price of the replacement part.

3. Labor Coverage

Labor coverage for warranty service is provided only during the customer’s applicable Term Commitment, as defined in the Terms of Service and Order Form. After expiration of the applicable Term Commitment, all labor, shipping, diagnostic, service call and related field service costs are the responsibility of the customer unless otherwise required by applicable law.

4. General Warranty Conditions

1. This Limited Warranty applies only to the original purchaser of the Covered Products and is non-transferable unless approved in writing by PowderWatts.
2. As a condition of this warranty, PowderWatts may require proof of purchase and/or return of the defective Covered Product or component thereof.
3. If PowderWatts requires return of a Covered Product and the product is determined to be defective, PowderWatts will pay standard return shipping costs. Products determined to be non-defective may be returned to the customer at the customer’s expense and may be subject to diagnostic or handling charges.
4. This Limited Warranty is subject to all terms and limitations referenced in the PowderWatts Terms of Service, available at www.powderwatts.com/legal/tos which are incorporated by this reference, as well as those referenced below.

5. Warranty Remedies

1. For valid warranty claims made during the warranty period with respect to Covered Products, PowderWatts may provide you with a substantially functional equivalent product or part to replace the defective item. Replacement products may be new, repaired or reconditioned, at the sole option of PowderWatts.
2. Any replacement product or part provided under this Limited Warranty does not extend or restart the original warranty period applicable to the original Covered Product. Replacement products and parts remain subject to the remaining balance of the original warranty coverage and prorated schedule applicable to the original Covered Product. However, if a replacement product or part provided under this Limited Warranty fails due to a defect in materials or workmanship within one (1) year after shipment of the replacement product or part, PowderWatts will provide one replacement for the defective replacement product or part at no additional charge for the part itself.
3. At PowderWatts’s sole option and discretion, in lieu of replacing the defective Covered Product, PowderWatts may instead elect to remove the Equipment and discontinue associated Monitoring Services, and issue you a pro rata refund of any prepaid amount for Monitoring Services. No other credits will be provided for cancellation or disconnection.

6. Warranty Service

1. For warranty service, please contact PowderWatts Customer Support at www.powderwatts.com/contact. If PowderWatts is unable to address the issue that you are facing, PowderWatts may determine the appropriate warranty remedy, if any, at its discretion.
2. Warranty service may be performed by PowderWatts or an authorized service provider designated by PowderWatts.

7. Exclusions and Limitations

1. This Limited Warranty does not apply in the following cases: failure to follow installation or operating instructions, misuse, alteration, abuse, accident or tampering, or damage or non-performance resulting from use of any item or repair services not provided by PowderWatts, as well as where your Equipment or any component thereof is obtained from a third party other than PowderWatts or an authorized reseller. This Limited Warranty also does not apply if damage was caused by Acts of God, natural disasters, labor disputes, war, terrorism, civil strife, or other causes beyond PowderWatts’s control, including but not limited to changes impacting the performance, operation or sustainability of third-party communications and technology platforms, networks and protocols. Consumable parts, such as batteries or battery replacement, and adhesive tapes or glues or caulking are excluded from this Limited Warranty. Products that are tested and found to be in good working condition or not defective may be returned to the customer at the customer’s expense and may be subject to diagnostic or handling charges.
2. Additional warranties or product protection plans may be offered if you purchase PowderWatts products through an Authorized Reseller. These ancillary warranties are not provided by PowderWatts and you should contact the Authorized Reseller from where you made your purchase to understand the terms of their offer and any protections.
3. This Limited Warranty does not guarantee uninterrupted operation or availability of software, cloud services, mobile applications, wireless connectivity, internet access, third-party communication networks, utility integrations, or third-party technology platforms.
